Kagan Knowingly, Willingly and Actively Engaged In A Conspiracy To Deceive The Supreme Court – This Is a Crime and Kagan Must Not Be Confirmed!

Washington, DC. – Documents released by the Clinton White House archives show Kagan’s “willingness to manipulate medical science to fit the Democratic party’s political agenda on the hot-button issue of abortion.”

Kagan’s plan to conspire and actively participate to deceive the Supreme Court is outrageous and even criminal.  Obama’s Justice Department is prosecuting Blagojevich saying his talk was conspiring and conspiracy is a crime.  Yet the same Obama White House is pushing Kagan to be confirmed to a lifetime appointment on the U.S. Supreme Court — with clear evidence that she intentionally deceived that Court and the whole country over the life-and-death issue of partial birth abortion.  Kagan is not someone who should be on any court, but likely should be in jail.

The shocking account of her criminal conduct appears to be true as Kagan flirted with perjury in her evasive answers to direct questioning on the subject by Sen. Orrin Hatch during Judicial Committee hearings seeking the truth about Kagan’s central role in crafting the spin that killed the Nebraska partial-birth abortion ban.

The Democrat controlled Senate Judicial Committee rammed through advancing the Kagan nomination with one RINO GOP vote from Lindsey Graham, SC. Take action NOW – the final Senate vote is coming - call RINO Graham TODAY at 202-224-5972 tell him to “oppose and filibuster Kagan” right away or he will be FIRED FROM OFFICE!!!!  The same with Lugar (R-IN, 202-224-4814), who has said he will vote to confirm her!!!!

The American College of Obstetricians and Gynecologists (ACOG), stated in their initial draft report for the Supreme Court that the ACOG expert panel “could identify no circumstances under which this procedure (partial birth abortion) . . . would be the only option to save the life or preserve the health of the woman.” That language horrified the rabidly pro-abortion Kagan, then an associate legal counsel to President Clinton.

This is what Kagan wrote in a memo to her superiors in the Clinton White House:

“Todd Stern just discovered that the (ACOG) is thinking about issuing a statement (attached) that includes the following sentence: ‘[A] select panel convened by ACOG could identify no circumstances under which [the partial-birth] procedure … would be the only option to save the life or preserve the health of the woman.’

This, of course, would be disaster — not the less so (in fact, the more so) because ACOG continues to oppose the legislation. It is unclear whether ACOG will issue the statement; even if it does not, there is obviously a chance that the draft will become public.”

So Kagan took matters into her own hands: incredibly, she herself appears to have written the key language that eventually appeared in the ACOG report. Shannon Coffin, of National Review writes:

“Her notes, produced by the White House to the Senate Judiciary Committee, show that she herself drafted the critical language hedging ACOG’s position. On a document [PDF] captioned “Suggested Options” — which she apparently faxed to the legislative director at ACOG — Kagan proposed that ACOG include the following language: “An intact D&X [the medical term for the procedure], however, may be the best or most appropriate procedure in a particular circumstance to save the life or preserve the health of a woman.”

Kagan’s language was copied verbatim by the ACOG executive board into its final statement, where it then became one of the greatest evidentiary hurdles faced by Justice Department lawyers This is an image of Kagan’s “suggested options” note; Select Here to enlarge:

“I’m really stunned by what appears to be a real politicization of science,” Sen. Hatch said, responding to her testimony. “The political objective of keeping partial-birth abortion legal appears to have trumped what a medical organization originally wrote, and left to its own scientific inquiry they had concluded.”

Stated Mary Lewis, chairwoman of the federal Life and Liberty PAC, “Kagan personally and individually was key, under Clinton, to keeping the barbaric and medically unjustifiable practice of so-called partial birth abortion in place. She did so by proposing a lie to the American College of Obstetricians and Gynecologists, and then providing for it obfuscatory language and necessary political cover — which ACOG, in a complete reversal of the plain import of their initial findings, then incorporated into their final report.”

Lewis continued, “She then lied under oath about what she had done, when asked by Sen. Hatch. This is criminal conspiracy; it is perjury.  This kind of sleazy ‘depends on what the meaning of is, is’ lawyer-activism does not remotely reflect the level of integrity required for the grave responsibilities of lifetime appointment to the highest Court in the land. Kagan must be filibustered, until the facts of this scandal are nationally deliberated, and this nomination is either withdrawn or can be defeated on its glaring demerits. Our nation deserves better than to be steam-rollered in yet another episode of callous and dishonest Democrat partisanship.”

We must STOP KAGAN with a filibuster in the full Senate!

Life and Liberty PAC is calling for the Senate vote to be filibustered by Republican members, and pro-life Democrats. “Any vote advancing the Kagan nomination process is a vote for abortion extremism, and increases the prospect of decades of radical pro-death judicial activism by the Supreme Court. Americans already have been railroaded too far by the Obama Democrats — yet another Supreme Court lifetime appointment on the fast track is a travesty.”

Sen. Jeff Sessions (R-AL), ranking Republican on the Senate Judiciary Committee, told HUMAN EVENTS magazine in a recent interview that he would not rule out filibustering Elena Kagan’s nomination to the Supreme Court. Sessions said that a “filibuster is not off the table,” but he cautioned that such a procedural tactic would only be employed under “extraordinary circumstances.” Asked if Kagan’s record and obvious inclinations toward judicial and political activism qualify as “extraordinary circumstances,” Sessions declined to commit, but he observed that Kagan did not “help herself in her testimony.”
